A person using somebody's intellectual property without their permission is an inherent violation of the NAP and is thus fundamentally immoral. Piracy may not cause monetary damages but still directly violates the property rights of it's creators, which still makes it wrong.

DRM is absolutely a solution, but only as long as it's clearly marked as part of the product. If you actively make your product worse and that worseness results in more lost sales then piracy, then the market will punish you.

Intellectual property was created specifically to allow proper remuneration of creators. Originally to protect creators from publishers - who would rake fortunes publishing books without ever paying the authors. Nowadays they are used to protect publishers from the public- while quite often allowing them to dispossess creators from their work.

There *is* an ideological stance at the core of IP rights and it's been broken for while now - none of the IP forms (copyright, trademark, patent...) play their intended constitutional mandate.

The PDP case is different since those dev's gave a blanket licence to everyone that may or may not be legally binding. Against, say, Nintendo, that defense wouldn't work.
