Now I have the item, and the money... do I keep it? I found something in a forum about eBay "ruling in buyers' favor without return needed if it won't be facilitated within 5 days." lol... It doesn't sound right, but the seller lied in his listing, cost me money/work, and was a total dick about it.

if it was damaged in shipping I'd have accepted it, but he admitted to not testing when he stated twice in the listing that he had and that it was working. Then he started accusing me of damaging it, which is impossible given how old the rust damage is. I just wanted him to cover the repairs so I could have it working like he said it was in the listing, and do the job I was intending to do with it. I know I'm being a dick now wanting to have it all haha, but I don't think I was being unfair asking him to cover repairs when he lied in the first place.

90% of the time when sellers "test" things on ebay, testing consists of making sure the device turns on and nothing goes horribly wrong once it is powered on for 30 seconds.

Should have taken the refund and gotten different equipmrnt.

can't be fucked going around and finding them all. did it with almost every purchase I made.
clothing, games, cd's & DVD's, things for the gf, hell even sex toys.
lots of knick-knacks and things from China that I didn't need at all I just got addicted to doing it.
If the item was under $15 there was a 99% chance I'd get my money back or a second one. $20-50 items were a little harder. anything to $100 or over was difficult but not impossible. I know I did it on one expensive item but can't remember what it was.

I'll send it back if I have to, but if eBay are letting me have this I'm taking it as compensation for time/money/work lost and karma's way of fucking the seller over for bullshitting

the client is a purist for a particular era of sound. He was only going to book time at a studio with this particular device, and that's what he wound up doing. I didn't have any luck trying to hire one, but the budget was big enough that I could buy one and still make money.
I'd have used a plugin, or one of my other hardware filters if he'd let me haha.

It was in a way, though I still do use a few of the items. I don't do it often anymore, but that's probably because I don't buy off eBay much these days.

eBay issued the full refund without mentioning anything about returning it. I'm expecting the seller won't be too happy about that, so that's why I'm wondering about it.

I realize that but it's good to know. In my company we have people email contracts back to us but insist on them mailing them back also. That way if things go south we have them on both mail and wire fraud.

eBay's return policy is via the global shipping program, so the lack of tracking would've clearly shown that I hadn't sent it back. And then he wouldn't have owed me a refund. Doing the eBay dispute was definitely the way to go. eBay have decent policy for protecting the buyer when an item is confirmed to be 'Significantly Not as Described', but if I'd just trusted the sellers word that he'd refund me when it's returned, he could have accused me of damaging it, or returning an empty box, and I wouldn't have any leverage.

I just hope it's over and he doesn't initiate some sort of appeal, but given I won on an appeal and they've said the case is closed I think it's done. I'll be pretty damn happy if that's the end of it and I get $20 more than I started with and a repairable piece of gear for nothing haha.

just in the last three months i've had 4 shipments go missing, none of the sellers could provide me with transit numbers, none offered refunds, only one offered to resend the item.

I don't get it. Why is everyone hating on the OP ? Seller clearly lied in the description and sent a broken item. OP was in urgent need for the item. Sending back an item takes an effort and OP had to waste time ordering and waiting for it to arrive to begin with. If anyone is a prick in this situation, it is the seller.

I have 12 years of good feedback on my eBay account, so I don't want any problems with it. I'm not scared, I've just had this thing for 6 weeks now and if I can be sure it's over I want to get it fixed ASAP. It just seems to good to be true for it to be over lmao

I've had this same thing happen twice before, but both times the seller was quick to cover the repair bill. One was nice enough to refund more than the repair costs for the trouble.
