He had to announce his intent to Anakin else Anakin could have countered with an 'it's treason then' negating the (moral) high ground advantage and synergizing with spinning.

Maul, however, has not dumped stats into spin and thus this tactic is unavailable to him. Kenobi knows this and it able to take full advantage of a surprise high ground attack to take the match.
