Now death sentence is nearly eradicated. We had less than 50 death sentences in 2015.

Why have we become much more gentle to the criminal population?

Durkheim says it's because the law has become more restorative and less punitive as we moved towards organic solidarity.

We used to have hospitals for people with mental problems. Now we shut them down and send them to prisons.

Personally, I don't find the Code of Hammurabi to be as harsh as some people make it out to be. In fact, in some of the rules, it is surprisingly "progressive," for how old it is. Here's a fine gem on an example:

Before this there was the criminal vs victim legal battle instead of the criminal vs state on the behalf of the victim.

A simpler time where if you accused someone of murder and they were pronounced not guilty you were then charged with murder. But then the witch trials happened and the church allowed people to accuse others through the church.

Childhood is idolizing hangings. Adulthood is realizing firing squads make more sense.

Hammurabi's Code was pretty just. It also commanded that the state pay for anything the offender didn't or couldn't pay for to the victim.

The reason medieval punishment was so severe was because of the complete lack of police to enforce the law and deter/prosecute crime. The death sentence was in place to make up for that in trying to deter criminals.
