Long story short, my friend took a picture of his girlfriend's back partially including her buttocks, but no real identifiable features. He sent this image to his ex thinking they were on good terms and she would find the image amusing due to some circumstances. In response she was bigly salty, asking if the girl who is the subject of the photo gave permission for the image to be shared (I don't know if she did or not) and suggesting that sending that image was "highly illegal".

To my friend's understanding of law, he owns the rights to that image and he can do as he pleases with it. Having seen the image myself, I can attest that it is not obscene, in fact it's quite tasteful. I've seen public advertisements that are just as and in some cases more obscene than the image in question.

What's your advice for my friend? Does he indeed have nothing to worry about as I suspect? I think he should just reply with a "yeah, she thought it was artsy, she was fine with it" but he wants to flaunt her ignorance of the law and make fun of her.

Thing is, she's a woman. You know how these situations go, liberal women are always going out of their way to try to ruin a guys life for whatever reason and """journalists""" will publicize the shit out of the girls side of the story without any regard to the consequences for the male or his side of the story.

Even if she tries to publicize him for whatever reason, the image really is not bad, the girl is unidentifiable and modest by today's standards. Shows girl's back and a little booty (music videos are more obscene). And his email was not incendiary, he genuinely thought she would think it's a nice image and the text of the email reflects that.

There are revenge porn laws in some states, but you'd have to litigate it and most people wouldn't spend all those expenses for a not so sure outcome.

In addition to, if it's in public it's fare game. There is a grey area in places where the subject expects privacy, etc. Also willingly posing for a photo is also something to consider. It really comes down to the expectation of privacy though. Intent can play a big part as well.

She has no ownership of it, and cannot profit from it, but he cannot use it for non-private means without permission.
