From what I remember, the President can tell the cabinet to act directly on issues in their portfolio. Usually these aren't as comprehensive as full legislation, but still quite effective. Congress can override executive actions, but the President can veto the override.

It is pretty much the only method through which a president can act. They are necessary.

So the president can't make free speech illegal because thats against the current legislation. It's also why Trump's first executive order doesn't exactly overturn ACA - read the order's title carefully - because the ACA is legislation and the president cant change it.

Executive orders were something used very sparingly, until Trump got in office and decided to act like a king. It is embarrassing how the people of this country are cheering on Trump as he strangles the republic to death.

An executive order is the President telling the bureaucracy to start or stop doing something on the basis of an existing law passed by Congress.

For example, Congress passed the Clean Air Act in 1963 which has since been amended four times by Congress. If we learned tomorrow that some chemical gas used in industry is actually very dangerous to the environment, the President could, by executive order, ban use of that gas.

When you hear people complaining about executive orders, they generally fall into one of two categories.
1. The President is using an existing law in a way the complainer does not like. (This is legitimate)
2. The President is using an existing law for an unrelated cause because he can't convince Congress to pass a law giving him the authority. (This is illegitimate.)

Some exec orders are downright unconstitutional, some argue they all are. It depends on your interpretation of our constitution stating the Executive branch and the President's job is to enforce the laws. This is a tool used to do that, and to set an agenda as well. Without exec orders like the Dakota pipeline and Keystone pipeline done today, we wouldn't get shit done. This should have been done by Obama fucking years ago.

The ACA in particular cannot be repealed by executive order, but broad power is given to the executive to handle its implementation. This was done intentionally by Democrats to make it easier for Obama to implement under the assumption Democrats would maintain control of government long enough to make the program permanently embedded in government.

Trump can order the director of HHS to grant waivers to every single person it would otherwise apply to, for example.

Executive orders are like light toothless legislative actions coming from the Oval Office. They're often unconstitutional. Many times, it's just the President telling his cabinet or executive agencies to behave a certain way within the purview of the organic statute that gives them the authority to act. The President has some control over the regulatory state.

However, every executive order can be challenged in court or overruled by the legislature.
