The President cannot ban people without citizenship or permanent legal residency (e.g. green card holders). Anyone else is fair game, per 8 U.S. Code § 1182. Congress has plenary power on immigration and they wrote the statute empowering the President.

To claim it is unconstitutional for the Congress to delegate power to the executive would require unraveling nearly all bureaucracy at all levels. Equal protection and similar clauses do not apply to people outside the jurisdiction of the United States.

If you're in federal court, the USC applies to everything. If you end up in State court and depending on your case, maybe a chance that your court docs don't mention the USC even once. Either way, the USC describes damn near everything the government can do and yeah, it really fucking matters.

Point of clarification, the constitution is the law of the land and it's a literal point. If you're on American soil, you're protected by the constitution. If you're a citizen, you gain the benefit of never being deported no matter how pissed off someone in the gov't might be.

If you're an American in another country, you're not protected by the constitution. Only way you gain that is if you're in an embassy or on a military base.

The Supreme Court isn't really happy with the 9th Circuit though.
