Circuit Courts are the last step in appeals before the Supreme Court. If something manages to reach the Circuit Court and is unchallenged it is basically federal precedent at that point.

9th Circuit is notoriously bad about opinions because they are based in San Francisco and tend to be full of socialists. It has like 80% overturn rate partly because California always passes stupidly unconstitutional laws.

Since theres no one ITT ill try and explain with my shitty knowledge of it. Basically it goes something like local - state - circuit - supreme court. If you think the court didnt do a good job of making a decision you can appeal to a higher court and they'll take a look at it. The supreme court is the highest law of the land, and it has overturned/overruled the 9th circuit "circus" court 80% of the time. They (9th circuit) have a terrible reputation for activism and ignoring the law. Now, the states like Arizona, Nevada and others included in that circuit are probably more than fed up with Califags shitting up laws and forcing them to play along with their stupid decisions.

This needs to pass. California is a cancer nobody wants to deal with anymore.

How would this change anything? All the judges that are there now would still be there after the circuit was split - there'd just be two liberal courts instead of one.

Nevada is as liberal as the rest of the West coast. Almost its entire population lives in Las Vegas, and they have a very large latino population. What do you expect?

The state court systems are separate. Yes their actions can be challenged in federal court but that's not relevant here.

The District Court is the lowest level- there is at least one in every state, more in bigger states. That is a trial court, with jury boxes and witness stands etc. They rule, and the losing party can appeal to a higher court, the relevant circuit (there are 13 - 1 through 11, the D.C. Circuit and a "Federal Circuit" that deals with certain subjects) Circuits can rule differently from one another- but the Supreme Court has nationwide reach.

Appellate review is not a re-trial, just a review of the record in the lower court to see if they made any mistakes in applying the law.

We are dealing with a preliminary injunction here, so all of this is abbreviated.

Does a federal judge lose any power if this happens? It seems to me that the 9th Circuit can be just as flaky and annoying even if it's reduced in size. In fact moreso since whatever balancing power the other states had is lost.

Yeah that's where the nuclear option came from. Normally judges require a supermajority, but the dems created a rule while they were in charge where they only require a 51% majority. People were telling the dems when they created the rule that it was going to bite them in the ass eventually, but they didn't care.
