i can't see this being illegal. there is no contract beside an implied contract, which says the man is paying. the contract with the restaurant is that the group(the couple) will settle the bill. the remaining woman would be breaking the law by not settling the bill, but the person leaving has no requirement to pay the bill.
the woman might have assumed that the man will pay, but that depends on the wording of the invitation/offer to go for dinner.
