California's Assault with a Deadly Weapon ("ADW") statute is California Penal Code 245(a)(1). The code reads as follows: >Any person who commits an assault upon the person of another with a deadly weapon or instrument other than a firearm shall be punished by imprisonment in the state prison for two, three, or four years, or in a county jail for not exceeding one year, or by a fine not exceeding ten thousand dollars ($10,000), or by both the fine and imprisonment
The California courts have declared on numerous occasions that a bottle can constitute a deadly weapon for the purpose of the statute. >*See e.g.*, *People v. Brown (2012),* 210 Cal.App.4th 1, 6-7 ("For example, *a bottle or a pencil*, while not deadly per se, may be a deadly weapon within the meaning of section 245, subdivision (a)(1), when used in a manner capable of producing and likely to produce great bodily injury.") > *See also* *People v. Zermeno (1999)*, 21 Cal.4th 927, 931, 89 Cal.Rptr.2d 863, 986 P.2d 196 (finding that a beer bottle is a deadly weapon)

But that was not the only bottle, there are others of her throwing bottles, each one of those instances a felony. Post those pictures. The jury pool will not include felons and non-voters so you almost have a chance for a trial.
