They could probably say they're a club and so you can have your club membership revoked for whatever reason.
It's why nightclubs can deny people entry for being men or being black, they can claim they're trying to get the right mix of people in the club or the right look. The cover charge lets them claim they're a private club that you're getting entry to for the night so laws are more lenient for it.
