Open/closed borders is not applicable to Libertarian ethics, the state cannot determine the wishes of all proprietors. The true Libertarian immigration policy is one where the property owners directly choose who comes into their own land. I know a lot of people get super ass blasted when accused of being pirates, but certainly not everybody in the libertarian mindset feels the same about it. I think it's well important within reason. Maybe not necessarily patents, but software for example.
In a sense, this is true. Middle ground approach to freedom is giving people the perception that they can meddle with what others do with their property, so it's just a matter of time before we end up with something that does not even resemble a market anymore, like today.
