In the event of a vacancy in the COurt, the President nominates a replacement, Thuis is followed by hearings in the Senate Judiciary COmmittee, and eventually a vote to confirm the appointment from the whole Senate. Following the Gursuch nomination, a simple majority is now sufficient. The appointment is for life, unless the justice retires or is removed from office, the latter never happens.

It should be noted that there is no Constitutional provision for how may justices serve on the Supreme Court. A President could say "I believe 8 is a better number of Justices, we'll just go with the 8 we have, I nominate nobody.

He could similarly say "Nine is not enough for the amount of work they do, and the complexity of cases coming before them these days, I am going to nominate 4 more to to run the number up to 13." Note that FDR tried this when he kept losing court cases, and thought adding some sympathetic Justices would help him out.

Congress refused to go along on what was obvious court-packing, and without confirmation by the Senate appointments are not valid.

But IF Trump nominated some extra Justices, and if the Congress went along, it would pass Constitutional muster.

ORiginally the court was organized by statute as having 6 members - on chief and 5 associates. It dropped to 5 in 1801, returned to 6 the next year. Number 7 was added in 1807, then 8 and 9 in 1837.

In 1863 a 10TH Justice was added, largely because at that time Supreme Court Justices had supervisory duties over the Circuit Courts, and there were now 10 of those.

Number established at 9 in 1869 .

It is now set at 9 by statute.

A President could drive that number lower by refusing to nominate anybody, but to increase it he would require Congress to create a new statute or the Court to find statues defining the size of the Supreme Court to be unconstitutional.

All that seems unlikely but would pass Constitutional muster.

Courts show grossly insufficient deference to the powers delegated to the other two branches, and to those reserved to the people and states.

Such "legislating from the bench" is a prime driver in the expansion of federal government powers beyond what is Constitutionally valid.
