It was already legal that they could possess guns, but the BoR was not entrenched into law thus it could be "violated" - the right to bear arms comes from the Assize of Arms 1182, NOT the BoR 1689. A Constitution is the framework for the governance of a state, not a Bill of Rights. A Bill of Rights is what you're (indirectly) referring to.
