Couldn't this be argued? The original Pepe from Boys Club had green lips and did not wear the same clothing. Furthermore, the personality in the book will likely have nothing to do with the original character since the book is based on the memes which have diverged significantly from the webcomic source. The only traits they share are that they are frogs and share the same name.
Wouldn't the aurhor just have to prove that the Pepe in the book is inspired by the memes and not the webcomic?

He sued somebody for illegally using his intellectual property in a profitable work. That is why it makes sense in that context.
He is not going to be able to sue all of these frogposters and rare pepe collectors because they aren't making money off that shit, they're not taking the character and purporting it to some tangible item with which they can distribute and sell. This is like if somebody, I don't know maybe a cartoon network creator, they saw how the internet is making all this art or edits or clips of their show characters and deciding that this is a gross violation of their IP's usage before telling the fans to delete everything or risk being tangled up in court affairs.
