The way it works is that wait staff are exempt from the federal minimum wage because they were traditionally tipped. So now they make ~$3/hr and if they aren't tipped up to minimum wage their employer makes up the difference. The really excellent wait staff can make 2-300 a night in tips though.

There's a lot of incentives for small businesses to do this for tax purposes. Its so that its worth someone's time and money to go out and start a restaurant. The food business is a terrible business. There's not a lot of money in it and the competition is tough.
That's why you tip, so the customer is in charge of what they think their server should be paid.
