Merit-based social structure is the greatest achievement of the enlightenment, and that's being destroyed. Creating a social structure based purely upon who or what you are when you're born (which is exactly the point of this diversity program): you're going to end up with inefficient, poorly functioning businesses and institutions as a result.

But that isn't happening. There are very few minorities at most positions higher than entry-level in most companies.
If anything, I recognize that if you fire a minority worker for performance reasons you may get sued, but those lawsuits rarely pan out if you do your paperwork.

That's bullshit. Most minorities in high positions at big companies are thoroughly qualified. Being non-white may have given them a boost, but nobody hires idiots.
Take Rosalind Brewer who just moved from Sam's Club CEO to Starbucks COO & President. Being black may have helped her along the way, but she's smarter than most of /pol. Degrees from Booth, Stanford, and Wharton. Maybe affirmative action got her in, but she graduated on her own merit.
