Hi guyz, Im polish bloger and Im currently writing small article about Communist Party of USA (cpusa.org/) and I have important question.
You might not know, but in Poland, political parties (and also all other kinds of organisations, in example students corporations or fundations) endorsing Fascism, Communism, Nazism or any other totalitarian ideology are illegal, and punished with up to 2 years in prison, so for Poles its hard to understand why Communist Party of USA is allowed to exist legally in USA- the worst enemy of soviets.
As you can see, my english is shitty, and I tried to find info by myself, but I failed, so could you please explain to me why it is legal for Communist and Fascist parties to exist in USA?
I assume its because of 1st Amendment, but I cannot find any understandeble for me text about that, and wikipedia page about 1stA doesnt say anything about activity of such political parties, for me it seems like 1st A protects only the right of the unit to share communist or nazi beliefs (which is also protected by polish law, yet it doesnt protect political parties right to propagate such ideology)

First Amendment protects both the right for free speech and the right to organize. A political party is exactly that. However, I do believe communists are barred from serving in the government.

But what about communist or nazi propaganda, such as posters, press and other stuff like that? I know Im allowed in US to say unpopular things like denying holocaust (very illegal in Poland, and in the whole EU), but am I allowed to publish my opinion in press? Am I allowed to organise rallies with such narrative?
I know a little bit of Greensboro massacre, so I understand that as long as I only speak about "physically removing" reactionists, everything is allright, the problem is when I take action, right?
Dont you have any statute, statutory law or any other legislation that regulates political parties?

You can organize any rally, start any party, or say anything as long as it isn't directly inciting violence. This means saying "let's go bomb the post office right now". You are fine to say things that'll indirectly lead to violence however; triggering commies who then start a riot will not net you an "inciting violence" charge.

You can hold all the nazi rallies and hand out all the literature you want as long as you're not doing anything directly illegal like calling for violence or seditious activity. Historically, that's how the FBI would keep tabs on you as a potential subversive.

This goes for most of the world - there are communist parties in basically every country on this planet - but no Fascist ones. That's mainly because the laws that are put in place strictly condemn National Socialism, while Communism is still an accepted ideology in some regards. Just look at most of Central and Eastern Europe - communism is not banned (except from Poland), you can still wear the sickle and the hammer or a Che Guevarra shirt - but the moment you deny the Holocaust or you are caught displaying a swastika you are sent to jail.
tl;dr it's a fucked up world when your compatriots can freely walk around with the soviet star but you can't even talk about the Holocaust or you risk getting prosecuted for hate speech.

I forget the exact statute but if you agitate a riot that leads to violence across state lines, for instance, that's a felony. So for instance all the organizers of these national riot gangs should currently be under arrest.
But the FBI has been ordered already to no longer even keep track of communists. They're too busy with more important things ignoring outright treason.

Im pretty much shocked because you can get arrested for even carrying CCCP flag in public, and yet theyre allowed to organise themselves. I will check that up as soon as i finish my article, and if you guys are interested how did polish commies avoid law, I can post what I will find here

They're allowed to have the freedom to express their ideas, even run a candidate, but they'll never be a major party, and if they even were to somehow get a party member elected, he'd be blocked by all the seats in congress, and the Supreme Court. If they somehow were large enough to take control of the congress, the army is under a specific order to seize direct control of the government and exterminate the commies who will invariably try to tear up the constitution in the name of their sick ideology.
But, as of right now they pose zero threat to the United States (the official party anyway). Democrats currently pose a much greater threat to democracy. For the moment they are protected by the first amendment, and are allowed to organize.

I know that feel bro, almost every polish university is filled with communist professors, thats because of the large KGB operation that started in the 60s, when they replaced pre-war jewish proffesors with well trained politruks (KGB agents specialized in marxist indoctrination operations).
