I don't care what you think about marijuana legalization, this move by Sessions is objectively bad policy that will have political ramifications for the Trump Administration.

It's a move that is unpopular with both parties and US citizens, which will hinder Trump's ability to get public and congressional support on important legislation.

It breaks a campaign promise, which makes Trump look like a man with no integrity who can't follow through.

It makes Republicans, champions of small government, look like hypocrites.

Most importantly, it is fundamentally a states rights vs federal rights issue, pitting state level legalization vs federal prohibition. Marijuana is not the right issue to focus this fight around. The same political capital could be used to challenge state laws surrounding more important issues like immigration or overreaching gun laws.

This line of thinking is retarded and ignores that there is a huge amount of leeway in how harshly laws are enforced, how resources are distributed, and pressure for enforcement from above.

Look at immigration enforcement then and now. ICE was still working as usual, conducting the same type of operations, and enforcing the same laws in Obama's term as in Trump's. But now Trump has increased the distribution of resources to immigration and the high level focus on enforcement of immigration laws. The same laws are being enforced to a different degree.

Sessions has a long history of anti-marijuana statements and has characterized his moves as a crackdown. This is not simply "enforcing the law", it's making enforcement of particular laws in particular ways a high priority. Couple this with legal marijuana already doing billions in sales and you create a major political issue out of the enforcement direction. Now that Session's move has been made, team Trump is left holding the bags on the political backlash on a decision that didn't need to be made.

Legalization on the state level means nothing if federal enforcement prevents marijuana businesses from operating. What does legalization mean if opening a dispensary gets you v&d by the FBI? Are you being intentional dense?

Leaving it to the states means deferring to state level laws for federal enforcement, ie not enforcing federal marijuana laws that conflict with state level marijuana laws. For example allowing cultivation and sale as permitted by the state, but still enforcing federal crimes like illegally trafficking marijuana across state lines.

Nice post OP besides all of the things you mentioned Sessions has elevated this issue over going after corrupt ex gov. Officials. The news cycle was all about the bias in the Russia investigation the corruption uncovered during it and the actual ties the Dems had to the Russians.
Sessions cowardly recused himself from this case which was his dominant priority and now hes going after states that have gone through the proper channels to change their laws.
As far as federal law goes I'll say this, the federal government does not have constitutional authority to regulate marijuana. Congress has unconstitutionally usurped this power via the commerce clause, but that very same clause ensures equal protection across the union. As we have seen with issues such as gay marriage, when one state legalizes things thats others prohibit it creates all kinds of enforcement problems. Congress has a contradictory stance here. Once one state legalized marijuana, to remain within constitutional standards congress had to remove marijuana from the schedule of controlled substances to safegaurd equal protection, created within the very same clause they use to justify their authority to regulate cannabis but the DEA is addicted to easy money via asset forfeiture which is also unconstutional. All of the problems and government constitutional violations stem directly from congress usurping a power not delegated to them but to the states and people, respectively.
Everyone do yourselves a favor and read the fucking constitution in it's entirety and understand it use a dictionary if necessary. Do it just to say you have if for no other reason.
