The CEO in that memo confirmed he was fired because of the views stated in that memo. Those views are protected under California State Labor Law.
Normally, HR would say they just fired him because they felt like it, because you can legally do that. You can't legally fire someone in California for having a particular political view. But the CEO said, in an official statement, that they did it because of Damore's views.
TL;DR - Google has no defense at all on this point. Their official, legally binding statement is that he was fired for political reasons, which is illegal in the State of California.
