The CLOUD Act would also create an exception to the Stored Communications Act (SCA) to allow qualifying foreign governments to enter into an executive agreement to bypass the human rights protective Mutual Legal Assistance Treaty (MLAT) process when seeking data in criminal investigations and to seek data directly from U.S. technology companies.

Someone correct me if i'm wrong but this seems like a big fuck you to cloud computing and I read it as a clear and present govt. attempt to break up these silly ass tech companies like facebook. Per the law, a tech company would essentially have to start hosting data in the country where there user is to avoid this arcane mess of a bill that allows the data to be exported at will. As such, what keeps the data retained is the local laws which can't be circumvented by the bill. Otherwise, by playing games as they have of hosting data outside of the country to avoid local requests, the US can still go after the data.

This was because of the Microsoft case in which Microsoft refused to hand over data from "the cloud" account of an accused criminal who is a US citizen to the police simply because the servers storing the criminal's data was in a MS facility in a foreign country. Microsoft noted that had the data been stored on a server in the US, they would have complied and not fought the order.

Logically, does it really make sense that if US law enforcement is serving a warrant to search the cloud account of a US citizen and the cloud service provider is a US company that they would not be allowed to search the account with a valid warrant simply because the server owned by the US company happens to be in one of their facilities in a foreign country.
