Separation of church and state isnt in the constitution bong. The closest we have in the 1st amendment says you can't establish a religion in the govt. Which is a far cry from a local nondenominational memorial to the dead.
The "separation of church and state" is just as binding as john Adam's quote "Our Constitution was made only for a moral and religious people. It is wholly inadequate to the government of any other."
