Not only does the official site say ps4 only it also says the Crash figure is distributed under a SCE license meaning it's a Sony property.
The only other figures with licensing were Bowser and DK for Nintendo.

Working on all consoles wouldn't negate the SCE copyright on the site though, it could always be part of whatever the deal was for Crashs ownership

Again legally required copyright takes far more precedent than anything else. Activision could still be publishing the games for all we know. It could be some weird co-deal like Sony and Marvel for Spider-Man. but if they're legally required to put an SCE license on the Crash content then SCE owns it, you literally can't argue with the legal aspect of it unless you're legitimately retarded.
I can guarantee you Sony owns it now.
