The story is bullshit

Emulation isn't illegal.
It's that most people use it illegally play games.

Can someone tell me the difference between downloading a backup of a game you own, and uploading a backup of a game you own?

Shouldn't they have the same legal standing since I own the game, and am not making profit? It seems so stupid.

the link it's not opening here
I don't think metroid-database would lie about it

I can understand current games, but people actually give a shit about the legal status of ROMs?

What does it say? The site seems to be getting hammered.

>Can someone tell me the difference between downloading a backup of a game you own, and uploading a backup of a game you own?

zero
but lawyers and other money hungers will tell you otherwise because it's their professional job to lie and deceive the judicial system

Not my fault nigga is playing at full resolution

BOYCOTT NEONINTENDO
SHITPOST NEONINTENDO
SEND BAGS OF SHIT TO NOA

Even if you own the game you're only legally entitled to use your own copy to make a backup. If you download someone else's backup that's illegal. If you upload your own backup that's even more illegal.

It's the original blog post with the links to the game

That just doesn't make sense. It seems like money hungry lawyers splitting hairs.

>underminds the value

What? Now, I'm against piracy of new games and such, but a 20 year old game that is no longer in print being playable by any means is not underminding any value.

Also this doesn't address people playing games (new or old) that were/are never even released outside their original country on consoles with some form of region lock.

>nintendo takes the exact same stance the PCSX2 forums take
IT'S BEEN TENS OF FUCKING YEARS
THE HARDWARE IS OFF THE MARKET

JUST LET PEOPLE PLAY THEM THIS WAY

FUCK

Companies have gotten themselves into this shit by wording agreements to say you buy a right to play a game not own it. So you should in theory be able to play as many back ups as you like.

>Nintendo expects me to shit out 10buckeroos for a snes game
Yeah nah, they can go fuck themselves

>What's the problem?
>The problem is that it's illegal.

Brilliant.

You can get Metroid II on the 3DS eshop, you retards.

You wouldn't know that, because you aren't Metroid fans.

I think I was to agree with what you're saying, but could you clarify what you mean? I don't see how their wording allows for that.

So basically because Nintendo is full of faggots who either sit on or ruin good IPs for the sake of innovaction nobody should be allowed to do anything with them.

Fucking Nintendo just die already so your IPs can actually be good again

Christ, what do I have to do to convince Muslims that Nintendo is Haram so they fly to Japan and murder them all.

Welcome to business where everyone trys to fuck everyone in the ass in one big ass fucking circle.

>THE HARDWARE IS OFF THE MARKET
That only matters for the patent term of the hardware that plays the games, though, which is in fact, 20 years from the application date. But I do agree to a point, since Nintendo likes to be dumb with its virtual console shit and obfuscate its charming older games so they can shill their half-assed, censored to shit titles.

I'm advocating AM2R not on legal principle, but on fuck-you-Nintendo-you-piece-of-dogshit principle. AM2R is a legal violation, but I'm glad because Nintendo can eat a dick with its modern philosophy of gaming.

They treat piracy like the fucking boogeyman.
"It's not open to debate! It's illegal! It doesn't matter if we won't get money on it anyway, illegal! I don't care if it's otherwise impossible to play it! Illegal!"

So what happened?
I assume they issued takedowns for the metroid 2 remake that just came out?
Even though it was more than just a remake and they did all the work themselves?

It's not a legal tribute.

Daily reminder

Hiring a prostitute pro-pedophile activist
>Legal, moral and do good for our image

A tribute 30th anniversary fan video game that took 9 years to make
>Illegal. The costumers who made this "game" will face the wrath of our expensive lawyers and the fairness of our corrupted judicial system.

Have they actually issued a C&D or is someone spreading misinfo?

Just stop, you're embarrassing yourself

Can't believe I'm even replying to you.

I'm speaking in general of a lot of games, not just Metroid.

View it like this: buying an illegal thing is one crime, selling that illegal thing is another crime. This isn't complicated, and it makes total fucking sense since you can do one without doing the other.

But they fired her because of those things

Your argument does not stand since she got fired

And blame the law to allow this shit to happen. I haven't been following it but does the fan project have any cost? No? Then it's perfectly legal

You are just triggered because you know it's truth.

It's undermining the potential value of re-releasing it. Are you retarded or do you just try really hard to make stupid posts?

It's free. Project page doesn't even have ads.

The blog that game was orginally released on is still fine, but Metroid Database claimed to have gotten a C&D on twitter but didn't do anything about the links for 2 hours

I want the guys who got in legal trouble to make their own original game in the style of Metroid. Original characters, original plots, original universe, etc.

>she got fired
because they discovered her second job was exposed not because her pedophilia activism.

>it's illegal to download abandon ware
Hmmmmm?

But there's no illegalities here. I own the game. It shouldn't matter where the backup came from, as long as I'm not making money off of it, and Nintendo got their money for it.

They don't need to re-release it, again, you're only reading part of my post.

Welcome to the retarded world of copyright law.

The law wasn't made when software existed, so they still treat it as if it's a physical object. Basically, they consider it to be the same as stealing a physical copy of the game, and you now have 2 physical copies.

> guy spends 10 years making a tribute to a dead franchise that a company refuses to revive
> it gets obliterated by stupid nips with no business sense

2 bombs wasn't enough

The download links were up about an hour ago

Companies are just jews. They'll try and tell you sharing a cartridge/disc you've bought is illegal despite everyone doing it anyway. Sharing back ups would be exactly the same if only it weren't for the fact infinite people could "borrow" your game and play it at the same time rather than 1 person.

It didn't get obliterated at all. The links on his blog are still up. This is just one fansite trying to bullshit some drama.

HAPPY 30TH ANNIVERSARY METROIDKEKS

ENJOY YOUR FEDORATION FORCE

The one you download is considered a separate copy. Remember you dumb fucking nigger faggots, we live in the age of non physical games being sold meaning one compilation of files is considered a separate copy from an other compilation of files.

You think that was not an excuse? You really think she didn't get fired for both?

>Nintendobaby throwing a tantrum that a massive company is acting like a massive company
Holy fuck, grow up you manchild. Pirate Nintendo games, emulate them, do whatever the fuck you want. Just because they don't want people doing it doesn't mean it isn't a victimless crime, there's zero negatives to doing so. Quit fucking crying.

what are you expecting from company that use to use CODE for WIIu online and sharing on 2016?

The download links are still up on his blog

The fanfare is retarded

your comment is offensive but it's true

An emulator is illegal. Roms questionable

It technically is because "abandonware" is not a legal term. Unless the owner forfeits their right to the work to the public domain they own it. Company goes out of business then the devs gain ownership over their work.

It wasn't her second job being exposed that did it, what did it was she was using her twitter and Nintendo products to advertise for her second job.

>true
Objectively wrong. She got fired for both her second job and her pedo tendencies. It's not one or the other

It's OK when Nintendo does it

You've got that backwards.

She wrote an extensive "college thesis" that Japan is opressed by United States and child porn is a form of art
hard to believe Nintendo hired her by accident

Not that user, but since what you're paying for is not the game, but access to it, you could claim that piracy would no longer be illegal since all you're doing is finding another access point instead of outright stealing.

This all stems from the fact that all IP holders are stupid enough to believe every single pirated copy is a lost sale.

It's OK when all companies do it as it is the norm

Emulators are legal as long as you acquire the information through reverse engineering, you cannot have any assistance from illegally acquired information.

ROMs are legal if you make them.

But it's the opposite. An emulator made from scratch with unique code shouldn't fall under any copyright breaching laws.
A 1:1 copy of copyrighted game code would be illegal.

Do they really think we're stupid enough to believe people emulating out of print games that are no longer on retail shelves costs the industry 15 billion dollars? Last I checked even if I legally go out and buy of print games Nintendo still gets no money, so why should they give a shit?

That would take actual talent

Maybe they just didn't look at it

Look, you really believe they would intentionally hire a pedo? Why would they?

If you spend 10 years doing illegal stuff it doesn't suddenly make it legal

However that is still wrong as the fact is the files being the same doesn't make it by law count as the same copy you paid for, you paid for access to nintendos copy not anyone elses.

>ROMs are legal if you make them.

Since all roms are equal (share the same digital fingerprint) download and making is the same thing.

>ROMs are legal if you make them.
and only you use them.*

>Look, you really believe they would intentionally hire a pedo? Why would they?

That's a good question but since she is a pro-pedo since 2012 on her twitter it's hard to think Nintendo didn't know

It's still there.

And even if it got taken down, you could still get it elsewhere. That's what happened with Streets of Rage Remake when Sega C&D'd it.

If nintendo knew they had 10 years to take it down.

When did I say that, fucktard? I'm sick of these nintendogaf shitters spamming threads about MUH OPPRESSION NINTENDO ISN'T LETTING ME ADVERTISE AND MAKE GAMES USING THEIR CHARACTERS WAAAAAAAAAH I THOUGHT NINTENDO WAS MY FRIEND

Make a fan game, don't advertise it, and then post a bunch of links so that people can redistribute it. Not that fucking hard, especially if you're doing something that breaks copyright law of a huge company. Nintendo faggots are like women and niggers at this point, all they care about is acting offended that the world doesn't revolve around their feelings.

>take down the file being hosted by another site
>don't go for the source
Nintendo is so incompetent it's hilarious

It actually isnt. The data of your copy is what you own, you don't own the concept of the data so you can't get someone elses data.

Who said anything about needing to do anything? You didn't read any of my post, as far as I can tell. Think, then type. Words are supposed to convey meaning.

>nindrone still defend this shitty fossil company that should die decade ago

There's no problem with uploading in and on itself, but there's a problem with distributing the uploaded copy.
>b-but I'm not getting money
neither is the company, and the issue here is that the people who would download your copy haven't paid for the right to own a copy, therefore, it's illegal for anyone other than you to download it.

Legally no, uploading or downloading a copyrighted work without permission is illegal. At least in some countries it does.

Technically it counts as an unlicensed broadcast in those places.

yes it's the same file and same ones and zeroes

Download a game you own probably isn't an issue but the person uploading it doesn't have the right to distribute it, even if they own the game too.

no one has ever defended this, go shitpost elsewhere.

lawyers only follow the law.
blame the legislators and/or the judiciary that are making these laws

is it safe to turrent am2r now or will i get vanned?

Nope, if the matter of your computer isn't melding together with all other devices that have the same data it is not the same data, this is how the term copy works. You don't own someone else's copy of the data.

the greatests thing about the internet is downloading copyrighted work for free trial or if you don't want to support that company

a freedom that is still worth in our days

If Nintendo were actually fucking competent, they would have sent a C&D while it was still in development.

>the concept of the data
Really makes you think...

Who fucking cares, people are gonna play it anyway and no one will buy the new Metroid.

The NX is gonna be shit and you know it. Nintendo is more than dead. Meanwhile some guy can make ten times a better job that an entire team of retards with an even more retarded director in charge.

I'm staring at my copy of the original cart right now.

No shit Einsten. do you want to illuminate us poor plebeian fucks with more of your unending knowledge on the subject?

Prosecution for downloading a "backup" is extremely rarely enforced, as in, it's not ever. It is still illegal, but no one fucking cares. A Metroid 2 remake is not a "backup" and resembles an emulated copy of a game in only superficial details, so I'm not sure why everyone here is shitting themselves over Nintendo's policy on emulation.

> if you don't want to support that company

If you don't want to "support" a company that's making a product you want you're literally going against the most fundamental aspect of a free market

Video games are not fucking politics, buy the games you like and don't buy the games you don't like.

I don't get what the problem is here. Nintendo owns the Metroid IP, and it's up to them to protect that IP as they see fit. They don't want people playing their games on anything but Nintendo consoles, and there's nothing wrong with that.

>What is copyright law

>it doesn't have the right to distribute it
everybody has the right to upload and share whatever they want when they want it's only illegal if it's child pornography or confidential information that may hurt someone

You can't know which one is mine copy and which one is yours because they are clones and have the same 1 and 0s in them.

actual copy + your own copy = legal
actual copy + someone else copy = legal

period.
