It's pretty dumb on Nintendo's part, but the backers don't exactly get "screwed" since they're allowed to grab refunds if they really want.
And let's be fair here, Sony is doing the exact same thing. A number of PS4 games have been receiving PS3 ports but SCEA refuses to let them be localized because they want to kill the PS3 and sell more PS4s.
