Because it takes money and resources to go back and patch it out. Most of the development teams have moved on to new projects or been disbanded, so assets would have to be refocused to go back to an old game. And for what? Most normies don't even know Denuvo is there in the first place, so publishers aren't going to invest in returning to old games and removing it. No, the only uncrackable drm is non-local computing. Just phoning home every so often can be spoofed. If the actual program is never run on your system, though, there's no way to crack it.
The problem with this being you have to have a gigantic infrastructure to actually support it. You are effectively turning every game into an MMO. That costs way, way, more than any theoretical gains you'd get from pirates buying your game.
