What makes you think they're stolen and not something else? It could be a person that buys broken ones cheap, fixes them, and sells them for a profit. It could be someone that got a bunch for their family, but the family didn't really want them so they go up for sale. It could be anything, nothing screams "stolen" about these.

It's much more likely they were stolen from other people, not a store. Otherwise, I can't imagine why the seller wouldn't be selling it new in the package and just saying it's an unwanted gift.

If they're asking $250 used then it comes with the dock and cable. Nothing says it doesn't come with them, and that's obviously a "I bought this and really don't want it but can't return it" price.
Usually the best way you can tell they're stolen is if they're selling for cheaper than retail.
Scalpers wouldn't make any profit if they sold it at a lower price, the method of scalping is to wait until supplies run dry and sell it for a higher price

Well normally you'd be dissuaded from stealing because the shop owner/resident would shoot you full of holes.
Felony theft charges start at $500. A Switch and game (missing the $30 charger and $80 dock assuming it was stolen from someone's bag) doesn't even hit that amount.
Even if caught red handed, the city/state will not jail them more than a day due to overcrowding.
The best security is to not let people know you have something. Even letting people know you have a gun just means they bring their own and steal yours.
If the Switch has digital games on it those count. I have OG 3DS that are worth over $500 for that reason.

You'd have to be really lucky to get a used game that's not scraped or covered in sticker residue from the Redbox is was stolen from, or a system that some junkie fuck traded in that's not filled with hash and dirt from the flop house they live in.
Well literally nothing I buy used was fucked up. And I buy used a lot. If they are fucked up then the price drops accordingly and I buy those sometimes because it's acceptable.
I bought an old as shit hacked PS3 with rusty internals and almost broken BD drive cable. I play for 6 hours at a time and it never had any problem.
When I was buying used games they all looked fairly new. No residue or blemish. Though I guess it's because people take care of them more.
