The switch doesn't actually run a freebsd-based OS, it just uses an unknown part of the codebase.
The switch's OS is pretty similar to the 3ds'.

the 3DS and wii u firmware uses some GPL software for the network stack and the inbuilt web browser, they comply with the GPL by providing the source code to the GPL bits they used on their corporate site.

For game consoles, unless you're Microsoft (Xbox) and have an OS team (Windows), BSD is a better option than Linux otherwise it would be too easy to create emulators because of the GPL.
