I imagine it uses the kernel, the hardest part to develop
the 3DS and wii u firmware uses some GPL software for the network stack and the inbuilt web browser, they comply with the GPL by providing the source code to the GPL bits they used on their corporate site.
the BSD code used in the switch firmware probably isn't substantial.

For game consoles, unless you're Microsoft (Xbox) and have an OS team (Windows), BSD is a better option than Linux otherwise it would be too easy to create emulators because of the GPL.
