So this guy takes his computer to Geek Squad for computer repair and the FBI is alerted they found CP on it. A warrant is issued and boxes of evidence are removed from his house. A judge reviews the evidence and throws out pretty much all of the evidence because the geek squad informants had such a close relationship with law enforcement that a warrant was needed to find the initial file in unallocated space on the hard drive.

The thing is, you don't find really don't really find file fragments by accident unless that was the service that was being paid for. Some time ago I download a chunk of the do/kument before looking at the contents and deciding "ugh, nevermind."
The NSA must posses the greatest collection of porn ever and certainly has given hashes from that collection to the FBI. It is natural to assume that hashes for other files of law enforcement interest would be searched for.
I assume automated data recover tools can take local control of HDD heads to read file fragments from between the tracks. An encrypted file system would protect my data. I should use encrypted containers for everything I do.

The FBI stuff (and really any computer forensics lab) will do all sorts of cool stuff that is unlikely to be fooled by changing 1 byte. It might even store a hash based on color levels or something, you can do all sorts of shit that is based on the content of the image and not its actual format or bytes.

What the staff were most likely doing is just using a 'deleted photo recoverer' util to scan for all the images on the disk (deleted or not) and let you skim through them quickly. If any nudes appeared then you either reported them for a payday if they were CP or copied them for your collection and if it's a hot customer with nude selfies then you copied everything.
