It's a giant meme here anyway; even if you are a prolific serial killer in a death penalty state, your actual chances of being executed are rather minute. It's just on the books in most states because it's too politically inexpedient to abolish it, though it's not going away anytime soon now that Trump is president.

Everyone gets that crime ought to be punished.

Everyone also gets that the punishment also ought to fit the crime, with more severe crimes having more severe punishments.

With this in mind it makes no sense to leave death off the table.

The only real debate should be over which crimes ought to be punished with death, but I think that things like murder are obvious.

Murder is not a cut and dry thing in the law.

Which is why death is a discretionary sentence in all capital crimes here (mandatory death sentences have been unconstitutional since the 1970s), as opposed to the Commonwealth countries pre-Abolition where death was (IIRC) the mandatory sentence for murder.


Ultimately I'm not categorically against capital punishment because it's le ebil human rights abuse or muh cruel and unusual punishment, and it can certainly have a place, but at least in the US it's a bureaucratic nightmare.
