Nah, the statu quo benefits everyone. Hundreds of Spaniards earn good money in Gibraltar, and the eternal Anglo avoids taxes. From the Spanish point of view, the Treaty of Utrecht -which gave Gibraltar to Britain- does not mention the waters surrounding the town, so by definition they are Spanish territorial waters. There is no such thing as 'Gibraltar territorial waters'.
However, from the British point of view, there was no concept close to "territorial waters" in 1713, when the Treaty was signed. Since it's British territory, the same laws apply like in the rest of the world, so the waters off Gibraltar are British waters.
