So, I made the biggest mistake of my life. I got a d.u.i. the other night. I blew 3 times the legal limit. I am so ashamed, and I may have ruined my life. No car for a job (insurance is cooked), looking at a criminal record, license gone for at least a year.

I am an idiot, and I am paying the price. I don't know how I am going to overcome this. I can't imagine what my parents are going to say, everything in my life was going so well.

Anyone have any advice to keep me going, or stories of how you got around being arrested/criminal record?

Still freaking out. Have not slept or eaten properly since it happened.

Cop here. Hire a lawyer. See if the cops fucked anything up. If not its just a DL suspension. Don't know what state you're in so don't really know how long you'll be without your license.

Just deal with one problem at a time, I got arrested for selling pills, almost went to prison 1 month after my 18 bday, was about to kill myself, didnt, things got better...eventually

first dui as long as you didn't kill anyone is a misdemeanor offence, loss of license for a bit and a few grand in fines, if you can't overcome that tiny hiccup in life you deserve to die. you sound like some over privileged kid with an over inflated sense of entitlement that has never worked hard for anything.

I was arrested and charged with same offence when I was in university.

Luckily, I was a law student and used a retarded ass legal defence and got the Breathalyzer evidence to be inadmissible, resulting in the only vital evidence being eliminated.

That being said, it's a terrible decision and you should feel every bit as guilty as you are feeling, however, there are paths you can take to reduce or dismiss this case.

I'm 24 and was diagnosed with stage 3 small bowel cancer 2 weeks after my 23rd birthday... anyways.. last fall while undergoing chemo decided to start a steroid cycle bc I was starting to look like a Holocaust victim... this combined with starting new psych meds made me go a lil crazy and after a verbal fight with my dad I tried to stab him with a knife.. I then fled to go shoot speed balls and got arrested later that night... I was committed to a mental institution for a couple weeks and am facing 4 misdemeanors counts.. haven't talked to my dad since then

Cop again. Lawyer will be see holes in cops report of he's any good. If you get convicted there's not much you can do. In my state DL suspension is 6 months. Usually it goes quick. It's only a very small part of your life and doesn't go on your record as a criminal offense. I know it's shitty while you're going through it but it won't / shouldn't affect the rest of your life in a negative way.

what defense did you use?

put on your baby face for the judge and walk with some fines and a loss of license, you're not going to "federal pound me in the ass prison'' get a fucking grip and overcome. time to man up.

First thing you should do is record everything, EVERYTHING that occurred in the hours leading up to, during, and after the encounter with the police.

Be fucking mindful of the exchange with the police, when your rights were read, when they were given to you again at the station, how long until you were given a Breathalyzer (not the roadside one), your access to a lawyer, holy fuck there's a shit ton of stuff you should be writing down.

I have a personal philosophy in that lawyers are completely useless if you aren't a complete knob-head and know how to read. They can't do anything for you that you can't do yourself. You lawyer will likely plea to a lesser (if possible) charge, or draw up some low-ball chance at a trial. You literally should save your money if he all he's going to do is plead guilty for you in a courtroom.

Hey bud it's no big deal. Think about this, how about if instead of just getting busted, you instead t-boned some car and killed 3 kids ??? That would have been worse, no ? Ya it sucks, and yeah it's gonna fuck up your life for a couple of years but get over it. Learn from your mistakes. Ultimately nobody got hurt and everyone got home alright.

In Canada, it is a criminal offense. They are notoriously hard to get thrown out. I have however found a good lawyer. I am told of the 100 dui cases he has had this year, he has lost 10.

I am still fucked, my license can be suspended for a year, and insurance will make it to expensive to drive.

I was in the same boat, ride program- blew over, blah blah.

It was a rookie cop and when I was reading the prosecution's disclosure of evidence, I skimmed through the officer's notes and he failed to read me my rights at the station prior to using the "official" toxicology device, negating my right to counsel which was a charter violation.

That meant any evidence post-arrest and attained at the station was inadmissible. I got pretty lucky.

I was drunk, I cannot remember them reading me my rights at all to be honest.

Buddy blew 2.5 x over and was basically caught red handed. Lawyered up and by the time it finally went to court they managed to get the charges dropped. Cost him $7000 dollars.

To the ameritards, here in Canada, at least in the province of ontario, a D.U.I. offence is in the same as any other indictable offence, although rarely treated as indictable it is usually prosecuted as a summary offence barring certain circumstances.

The point is, it carries with it a mandatory criminal record, loss of license for 1 year, along with fines. It really does fuck your whole world up here, literally. There are no "slap on the wrists" when it comes to this. You're fucked, period.

That being said, if you present enough doubt in the strength of the case for the prosecution, they will more often than not resort to reducing the severity of the conviction to something in the H.T.A instead, like careless driving or whatever. To do that, you need either a good lawyer, or know what the fuck you're doing

That's not the point, when you go to court, ask for the disclosure. That's the evidence the crown has and will use against you should you choose to request a trial-which by the way you have every right to do, and those take forever to set up which means you technically get your license back after 3 months and since there hasn't been a formal conviction= no record= you get to go back to your normal life until the trial.

Anyway, get the fucking disclosure, and read over that thing like it's the bible, or your first porno mag. Comb over every fucking detail and see if there's any weaknesses in the case. It doesn't matter what you remember or not, EVERYTHING in that document pertains to your arrest, so the cops will have taken notes of all the verbal and non-verbal exchanges that were made that night. Including their procedures

Here's how it works, let me learn you on what it means to be charged with something, and convicted of something.

What has happened to you, as of now, is a charge. The crown (the province) is accusing you of a crime. They have to PROVE the crime in a court of law , or by you pleading guilt to that crime. Until then, all they are doing is accusing you.

Once you go to court and say "I'm guilty"- or a trial occurs and the judge finds you guilty, then you are said to be guilty of the crime and face the consequences thereof.

UP UNTIL THAT DECISION IS MADE IN COURT, nothing is bound and nothing is formal. You DON'T have a record as of now, you DON'T carry the penalties that come with a D.U.I. conviction, and you DON'T lose your license for a year- until- that judge formalises the charge in court.

How it works in most provinces is that a dui ARREST carries with it a mandatory 3 month ( I believe) license SUSPENSION. Whether or not insurance companies become aware of this I'm not completely sure, that's up to the insurance companies and how they operate . but from my general knowledge, most companies only record convictions, and suspensions are just that, suspensions. so the suspension will show up I believe but the reason for it isn't documented.

tldr;

think of it this way, if someone yells that you're a rapist- it doesn't mean fuck all until you're standing in court and the judge affirms that you are in fact, a rapist.

Got a DUI back in 2013. Shit was really rough for a year and a half but you get through it. Start attending Acohol classes and community service before its wven court ordered. The judge will nost likely be really lenient on you if they see u put in an effort.

thanks man, I appreciate the run down. I have always been a good person, looked out for others. I am the first person friends and family phone when there is a problem. So this is why I feel so ashamed. My life was going very well, I just made this terrible mistake.

My first only only arrest was about 2 months ago.

It really fucked up my life and I'm still dealing with it today so I can't include certain details but it's an interesting story to hear and it may keep others from making my mistakes so here goes:

>about 2hrs to other city, done it dozens of times before
>everything going good, but both of us still anxious as always
>both pop xanax/fent before heading home
>smoking blunts entire time in car(genius)
>midnight, about 5-10 miles from homebase
>car behind us, know its cop for sure

>Inside car is 100 xanax bars,20-ish pressed fent pills, 4g coke, 7oz weed, weed/coke scales, 2 grand cash, and .380 loaded
>friend was driving, immediately officer tells him to step out

>arrested on pub intox, drug poss, and weed traff
>spend night in jail had money to bond out nxt day

>mfw lost over 2 grand in cash/drugs
>friend lost around 5 grand cash/drugs

All my charges were misd. but on top of losing tons of money in drugs/cash from seling drugs, i am now facing thousands of dollars of fines after jail/court/lawyer/ect. But that's not even the worst of it, I still have on going court shit(fighting AI charge), will have criminal record for a long time probably forever, and after this event police have started to look into my previous criminal history which is lengthy and i cannot discuss but this only made my anxiety worse. Friend and I no longer speak.

Crime doesn't pay, kids.

Relax, I have many friends that have DUI's that are prefectly happy and doing well financially that aren't terrible people.

I'm from California and got a DUI last year. Don't get a lawyer. All that they can do for you is pretty much go to court for you.

If they have breathalyzer on file, etc etc etc, normal drunk driving check; a lawyer cannot do much to help you. (at least in my state, and talking to other people who have had DUIs and decided to hire lawyers)

A friend of mine said his cost 1500$ and did nothing for him. Settle with a public defender; your life will be ok after you do your classes and community service.

Take some time to assess how you want to deal with your situation. Don't make irrational decisions, come to terms with the fact that it happened, and that you made a mistake.

It's not the end of the world, but it should definitely be a learning experience, they don't fuck around with these charges around here.

Yes, you read that right. We had beer in the car, spilled beer in the car as well and were stoned to boot but I wasn't fucking drunk.

My lawyer suggested that I sign up for the DUI coarse the state offers which shows good faith for when you go in front of the judge, also I think, that we pay the fine(s) ahead of time as well.

The lawyer also asked if I took a piss test (I was high remember) which I did and actually pushed the court date forward which made the piss test impossible to get the results from in that short of time (this was 1990 and you couldn't get piss tests at Walgreens).

He was a smart lawyer.
In any event, the judge withheld adjudication and that was then end of it.

I kind of rehabbed myself, fast forward to today and i haven't touched any drugs since, moved cities and am currently working part time at grocery store(drug tested so not even weed) and doing summer odd-jobs. My friend was court ordered a mandatory 6 months rehab last i heard.

I'm certainly a much better person today than i was then, but i don't think i'll ever shake the anxiety and guilty conscious. I honestly only wrote this in hopes that anyone doing the same shit will read it and quit while they can, cause there's seriously only 2 outcomes: A grave, or a cell.

Nothing was stopping me from having road beers. I was putting them away like I was at a bar. I was certainly not in a bar. I was driving a big s.u.v

I know the feeling. Before my arrest I never drove sober, and eventually i was getting so high i could hardly drive at times so aside from wrecking and killing myself/someone else(the most selfish shit in the world) i was on a path to killing myself from any number of drugs i was doing every single day and in combination with each other. I look back now and an awestruck by how I'm still alive right now. Life is so precious once you learn to appreciate it.

been there, got pulled over by a trooper after my first dui, i had like 8 beers with my old man and drove home, trooper knew i was over the limit and screamed in my face, followed me home and let me off the hook, after that i will never get behind the wheel after a single fucking beer, but yeah i could have killed myself.

we were not meant to do that to ourselves for any longer. It will be something else that gets us.

Bruh, I got one when I was 22. It really sucked at the time, yes. Probation, fines, suspended license, community service $3000 surcharge, had to take classes and go to a MADD demonstration and yadda yadda. It really did suck, no denying it. And life felt over at the time.

But here I am, 32 and with a good job making good money, a wife, a child et cetera. All of that seems like a lifetime ago to me. Just take a deep breath, user, and believe me when I say you'll be alright. Jump through the hoops they're gonna make you jump through, take your punishment and do what you have to do and one day you'll be moved past it all.

Also, obviously, learn a lesson from all this.


Again user, buckle down and accept responsibility and your punishment and life will move on. It's not a felony, after all.

I had numerous close calls before mine. I smashed a new Camaro into a guard rail, somehow talked my way out of the cops doing a breath test. Tow truck driver told them he thought i was intoxicated.

About a year before my DUI, I got into a one car accident at like 3 in the morning. I was about .5 mile from home, too. Was going to just drive my crippled car the rest of the way but it wouldn't start. Some couple that stopped to see if I was alright called the police. I was shit faced. Had been drinking beer for hours and smoked a bunch of weed. For some reason the cop didn't give me a sobriety test or even inquire about how much I'd had to drink. He just callled me a tow truck. It was weird, my city is very hard on DUI.

i drank and drove along a 4 hour drive. I driving a minivan. When getting close to the destination, I was taking corners consistently in the rain where my tires were just starting to slide out. A miracle I didnt end up in a ditch that day.

No problem, user. Sorry it derailed some jobs for you. It'll be a pain and maybe even a hindrance in life for a while, but not forever. Keep your head up even if/when things get shitty and keel and a positive outlook toward the future. It's what got me through.
