i wouldn't recommend law school to anyone, but since you're almost done you should stick with it. unless you fervently and absolutely want to become a lawyer, it can be a depressing pain in the ass. however, that being said, if you do it right you can be very happy, make a huge difference in a lot of people's lives, and make a lot of money. what kind of law do you want to practice?

Without knowing what you're going to do, my biggest tip is to keep a good keep a healthy personal life/professional life balance, and never sacrifice the quality of the services you offer to make more money. you should become profitable only because the services you offer are stellar. not because you take too many cases, or you settle for a substandard result for your client to get paid.

it depends so much on the circumstances. you always have the right to not say a word. however, that will be held against you later. I know you have the constitutional right to not say anything, i know. but judges and juries will still hold it against you.

best rule of thumb is this: if you aren't committing a crime, talk openly and be extremely friendly and polite. If you have committed a very minor crime or are on the border of committing a crime (like if youre driving and you've had just a little too much to drive), you should probably talk openly and be extremely friendly and polite. if you've committed a serious crime, shut up and dont answer any questions. but do it politely.

I'm a legal file clerk. The guy I work for right now is completely nuts. Nice guy, smart, tenacious, but sloppy as hell. His briefs are a complete mess, he brings up all kinds of irrelevant crap and refuses to tie it back to the case. Always getting sanctioned. And he's well-known among lawyers in the area as a fruitcake.

So I guess my question is, how do lawyers like this manage to stay in business? He does win much of the time, but he wastes so much of everyone's time and energy getting there.

Let's say your ex wife claims you molested your son. Then let's say the police interrogate you, keep you there for 9 hours, you begin loosing sense of reality and then they came at you with all sorts of "truths" about how you DID do it,etc all agreesive.

Now let's say you were to break down emotionally after months of custody battles and admit to things you didn't do. You were crying, lost and completly broken

How fucked would that person be? Could a lawyer argue that the person was pressured into giving a false confession and was emotionally stressed because of the fivorce, custody battles, etc?

if you're willing to practice this way, its actually an ingenious way to stay in business. you clearly understand the law and how things are supposed to work, but the large majority of clients dont understand. there are a lot of people out there willing to pay for an attorney that will "fight for them," which often includes throwing shit at the other side that is irrelevant and inflammatory. but if the attorney gets the results necessary in the end, clients will keep coming back. and be willing to pay for it. i know plenty of attorneys like that. part of me wishes i could practice like that to make huge money, but i just cant do it.

one day, the attorney you work for might step in shit and get sanctioned, but he would have to really fuck up to get his license revoked. it takes a lot.

Not OP but there is no simple answer. Different courts have ruled different ways. Often times if you don't just take a plea deal you're looking at a jury applying the Miller test. They're going to show those pictures to the jury and you're going to have to convince a bunch of normal people that they're not obscene. Good luck with that.

dont risk it. there are plenty of borderline illegal things that are worth risking. this one is highly investigated, thoroughly prosecuted, and severely punished.

Because that's basically what I am going through. My lawyer said the crown could choose not to press charges but they'd only call me 1 day before the first date. He also said he would go for me amlsond postpone the case so he can review evidence, etc.

You're going to end up competing for pennies working at ACLU or as a PD. And PD work is far more likely, where you will need top grades to get in, get paid 55K, work hundreds of cases a week, work long hours, and be shit on by everyone.

It's tough to describe how idealism dies in law school. On the other hand, some new goals are formed and shaped. Above all else, you need to have strong reading and writing skills that can be applied in a variety of settings. If you don't have that, don't bother.

sounds like you're in a different country than i am, so i can't say i have the best advice for you. my only advice is this: get the best attorneys you can find and pay for. just because they're more expensive doesn't make them better. get as many referrals as you can, consult them as much as you can, and make sure you're confident to put your life in their hands.

yeah that was my (OP's) response. i already said i dont recommend law school, but i dont want to crush his dreams. he has noble goals and is in his 3rd year. he is probably in huge debt already and its too late to back out, we shoudl just encourage him.

plus being a PD isn't bad, i worked for the state for years and i was very happy.

sorry, that question is too vague to answer. i dont know the charges, the sentencing structure in your state, or the true strength of the case against you. they sound like serious charges, but hopefully if they're clearly bullshit the prosecutor will dismiss them outright. just get a good attorney to help you.

i got arrested for posseision of cp, the case took about 1.5 years to be closed. i was very cooperative, answered all the questions (pleaded guilty at the first opportunity) there was no fuck around any where all realtively straight forward. i got sentenced to 4.5yrs of prison that got suspended.
i had a great lawyer that did alot of digging etc,

judges should get pissed about this if theyre citing something that's not binding precedent in a misleading way. if the citation is open and apparent about where it comes from, and it makes sense in the argument, then i get it. i understand citing dicta more than dissents. there is a lot of situations out there with no case on point, so you have to draw an argument from somewhere

i was a prosecutor for a long time, and i did it all the time. there are lots of bad prosecutors and bad lawyers out there. not all of us are.

you're right. getting a good attorney who is very familiar with the local prosecutors and judges is vitally important in this kind of situation.

It's not my legal troubles but somebody close to a family member. I've not been informed on all the details but it seems somewhat suspect. It's hard to believe that somebody, who is facing heroin distribution charges magically comes up with a story about being molested by somebody that hasn't had contact with that person in over 10 years. Allegedly the deal struck with the police wasn't admissible in court, which would seem to be obvious to the jury the whole deal stinks, so the person was convicted. I guess now it's up to the judge at sentencing to make the decision

well in that case, it's a molestation conviction bottom line and the chances of the judge doing a downward departure from the guidelines are about zero. so expect the lower end as a minimum, and probably somewhere in the middle

i had over 5k images in my possession (every 10 sec. of vid is classed as an image, i argued this untill my lawyer found out the reason.) again i was very cooperative, neat dressed etc. also had a history of seeing psychs prior to the arrest, all on record etc. so i believe this helped alot. had my parents as witness and support people as well a letter of recommendation (or whatever it was) which was supposedly very good, the judge mentioned it multiple times in the hearing.

Thanks. It's not going to really effect me personally but the person who will be in jail and the family friends will have a rough patch ahead. I've told them that if something is going to be appealed, the conviction needs to happen first. I think that if the case is appealed with the evidence if the "I'll give up somebody so I don't go to jail" deal is presented, the conviction will be overturned. The parents of the accused don't have a problem spending money to set it straight
