With DNA evidence the margin of error for murder cases is extremely low.
I think anything with a high degree of malicious premeditation, torture, or murders of multiple people should be up for the death penalty.
At least in NC (where court battles have stopped the death penalty for a decade now) you have to majorly fucked up to be on death row and the jury has to unanimously decide it's worthy of death. If there is a single person that says no it's a life sentence and there is no re-trail for life/death.
