More or less how my lawyer put it, though he said due to the way they handled it (which I can go into detail about) that there's a good chance of it getting dropped. My state is big on actual physical control but considering my truck is gpsd and they didn't say anything to me and just arrested me well after I was out of my truck without even telling me my charges they have a weak case.
