Honest, serious answer: It really depends on the episode. Sometimes Tom is in the wrong, sometimes Jerry's in the wrong, and sometimes neither are in the wrong. I would say that Jerry is in the wrong more often than Tom, though. Especially in anything modern.

What sucks especially is that WB has an online MOD program that would be perfect for releasing these old cartoons uncensored without having to worry about soccer moms jumping on their backs. Yet, as far as animation goes, all they ever seem to use that program for is mostly obscure 70's Hanna Barbera shows that no one gives a shit about.

It's been almost five years now since Tom and Jerry volume 1 had been released on blu-ray and from what I recall, the restorations for the shorts in volume 2 had already been done before they cancelled it. When is WB going to get that stick out of their asses?

Deitch's other, non-T&J shorts are actually rather good and comfy. Judging him only from his T&J, you'd expect him to be a sadist who hates cats, but that's actually not the case.

However, most people on Sup Forums have probably never seen them, because they're so damn obscure. They haven't even been shown on Boomerang.

Allegedly Hanna and Barbera got several letters from fans rather irked by the heavy punishment Tom suffered in the 40s shorts.

As a result, many of the 50s shorts actually let Tom get the last laugh (most of which were karmic victories due to Jerry starting the feud).
