He still does that even if you just intimidate him or just bend his arm without out-right breaking it. Telltale can and will be kind of stupid and lazy sometimes.
It's probably roughly the same or maybe even worse in terms of whether your choices really matter. Hard to tell without the second episode or really even the rest of the season, but just the choices you can make and how at the end of the episode there's a news story that recaps your major choices, not to mention there's probably not too much Telltale can/is willing to do to deviate from some typical Batman stuff, makes it seem like there's no real lasting point to the choices that'll really deviate or make a difference compared to if somebody was playing with opposite choices from me. That said, I will give them that some of the immediate satisfaction from choices and getting to choose how Batman acts is more entertaining than when controlling other characters in other Telltale games.
