I think there was an issue in Ultimate Spider-man where they talk about this and how they just process and release every villain that gets stringed up in front of the police offices due to it being so counter to the system.

But court isn't the threat here. He's telling people to act right or he will personally come to rectify the situation.

The way you handle that properly in a modern story is have Superman actually handle whatever violent wrong doing the mastermind orchestrated and then have Clark or Lois show up with the evidence to convict the mastermind.

I like how Daredevil handles it. Everyone totally knows who he is, but he uses his lawyer powers to suppress it, so the gubment won't hunt him down for DD's actions.
