it's actually a product weaker rather than strong IP laws, in other countries IP holders can be more relaxed with turning a blind eye on others using their stuff because they can still always go after undesirable usage, in the US you have to make an effort to guard your IP from everyone or else the defendant who is actually an asshole can bring up all the other instances that didn't get sued as a reason they should be allowed to use it.
