actually her being a mutant or not would have no bearing on that, Fox doesn't have the rights to her because she's never been an X-Men associated character, if anything her rights are probably under Iron Man's subset since she made her debut in an Iron Man comic(indeed they've actually ramped up her Iron Man connections since her solo started)
