You will need Class 3 licensing, which is a very expensive and tedious process. Once you have class 3 licensing you will then have to purchase this specially from either the government itself or from another class 3 seller. The ammo will need to get approved by your local law enforcement by means of a tax stamp of other approval before you can purchase it because this falls under the "destructive device" clause of the NFA.

This entire process will probably cost $100k+. It's not even worth it unless you're a billionaire with a hard on for guns.

You can buy the 40mm brass and roll your own if you're a chemist who doesn't care about the law. There's books on filling them with whatever you want online.

If you're at that point you can buy a 37mm "flare" launcher from spikes and a 40mm tube separately too. Illegal though.
