Nothing is out of ordinary here, the problem is that the Senate always confirms the heads of dept's first, and then yea or nay's the offices that are put forward after that. these are seen largely as informal Presidential picks, b/c its done after a head of the dept is sworn in, so its not just the President, its also the head of the dept that gives input.
