Most everything nowadays has a privacy policy and end user license agreement that you sign on to by continually using the product that says something along the lines of "you put it in there, we can do what we want with it."

That's not at issue. This is about safeguarding PII. There is nothing that restricts an individual from signing an EULA/TOS.
