Maybe ya'll recall my thread from a few nights ago... tl;dr my roommate in college is facing serious felony charges. (he's black)
I'm worried that his legal representation will want to subpoena me, as I witnessed part of his arrest but chose to leave the apartment to avoid dealing with the police. Problem is his friends have told me all sorts of terrible shit that I told them "stop, you're incriminating your friend" multiple times over.
If I were subpoena'd and forced to testify it'd be disastrous for my roommate. How to I explain this to his friends? Should I just be blunt and tell them, hey, if I'm subpoena'd I'll answer questions but god damn don't force this shit.
You testify and he goes to jail You refuse to testify under subpoena and you go to jail.
Benjamin Jenkins
If it's felony you might as well call 2 or 3 lawyers to bounce the situation off them. They won't go too far with it, but the initial consultation is usually free, and then you can get a reading on it and make a determination about whether you think the legal costs would be worth it.
In the end, if you get subpoenaed, your options could run anywhere from not showing up to pulling some technicality to putting just the right spin on it. You might even jut try to get some advice about how to deal with their concerns.
William Harris
This. Also black criminal roommate, why would you not just testify and send him to to pound town?
Hudson Harris
What did he do
Samuel Diaz
Also, being friends with criminals is an easy way to become one.
Drop the friends. I assume you want to be friends with them because they sell you drugs, so stop the drugs you degenerate.
Alexander Bailey
nuffin obviously

It sounds like the best way out is using the fifth amendment. It's something you have to specifically invoke, and there are rules regarding it's use. If you wish to use it, you have to invoke it by name at the very beginning of your testimony, if you actually start giving testimony you are considered to have waived your fifth amendment rights. It is not something where you get to pick and choose statements; you either say everything, the good with the bad, or you say nothing at all.
Henry Fisher
^ this is probably true
How does it benefit you to lie?
Jason Howard
Because:
1. Unlike him and his friends I'm going places in life. I'm at the top of our graduating class, am accepted to the top graduate program in the country for my field, and am a Veteran who takes this shit very seriously.
2. I don't want to piss off his black friends but they seriously keep making shit worse. Tonight they told me they've been into his room to "get stuff the police missed" - do they not realize they just made me an accomplice to some shit?
3. I don't want to fear retribution if I am called to testify and tell the fucking truth, 100%. This asshole was resisting arrest. Whether or not it's exactly like the police say is not my problem. That's the defense's problem. How they discovered the gun ON HIS PERSON is also not my problem.

This. But answer the ?s and lock her up

5th is for self incrimination. Your advice will get him contempt and if you are a lawyer a malpractice suit.
Austin Martinez
The 5th Amendment protects you from self-incrimination. Refusing to testify in a criminal case when you've been identified as a witness isn't self-incrimination. It's contempt.
i remember your thread OP. roommate got busted with weed guns because he pissed off some chick.. you were a pussy fag then and even a bigger faggot now, Just testify and say you were intoxicated. that makes you NOT credible witness.
Jackson Hernandez
"Allegedly"
He has been dealing felony amounts of marijuana and other substances (??) from his dorm room. I had no idea, desu. Suspicions maybe but I don't do drugs and view it as none of my business.
He has had guns on this campus, which is against the law, for all 4 years of college. At a minimum this semester.
He got into an argument with some girl at a party, she felt threatened and told college staff about the situation. She mentioned he may have a gun.
Campus safety, staff, and police come to search his room based on alleged threat. He then resists, or at the very least must be restrained by force for whatever reason. I leave at this point. I have no idea what happened after I left. 10 minutes or so later he is in handcuffs and taken out of the building. I come back to see what happened and police tell me he resisted and reached for a firearm. I had no idea he ever had firearms here.
Aiden Sullivan
>Tonight they told me they've been into his room to "get stuff the police missed" You have to be careful about typing stuff like this into the internet.
That's seriously something you should bounce off a lawyer of the phone if you're thinking about how to not testify about things you don't want to.
Leo Peterson
I did have dayquil in my system, which does affect me.
Kayden Moore
Don't be a fucking retard.
Before you testify tell the police the other niggers in the pack threatened to kill you if you testify.
Rid the streets of multiple dindus.
Alexander Ross
I am so glad that I can rest assured knowing that someone will always be there to provide the correct response on Sup Forums. I didn't even need to show up today.
Charles Stewart
tell them you had a ton to drink that night. YOU are not on trial they don't care about you. can't arrest you for drinking under age if it was weeks before.. quit being a fag
Lucas Thomas
I'm 27, so that's not a concern.
Aaron Adams
his public defender will help you out. or fuck him. send him to jail for bringing a gun in the house. i am out. good luck.
