You can only declare war on a state. Warlords and terrorists are not states.

The War Powers Resolution allows the President to conduct military operations for 60 days without the consent of Congress. If Congress does not approve it within the 60 days the President has 30 days to withdraw American forces. When it comes to Afghanistan they are still operating under the authorization that Congress granted in 2001

Only congress can declare war, but a declaration of war is only needed if a conflict lasts more than a certain duration. IIRC 60 or 90 days, I think. In other words, president can unilaterally decide to attack/invade a country, but he has to stop after that duration if he doesn't get congress to declare war.
