Comey's defense will probably be that what Trump said wasn't a felony, which will also be Trump's defense. In reality prosecutors have broad discretion in what charges to bring. Pursuing something this minor against a major public figure, especially one who used to be the nation's chief LEO, is a guaranteed way to get BTFO professionally.
Trump did nothing wrong either. He might have asked a stupid quiestion (I.e. "Can we lock up some of the journalists who have been leaking classified or false info?"), but that's hardly illegal and only looks bad to people who already hated Trump. Obstruction of justice RE: Flynn is a nonstarter as well, because 1) Flynn did nothing wrong 2) the President reportedly only said that they shouldn't bother pursuing the matter because he would pardon Flynn for whatever came up. This latest controversy is just political theater put on by the military industrial complex.

Eh, not really. Comey himself would be considered the civil authority which this information would be reported to. He'd at best be regulated by any FBI internal rules about how to handle evidence, which may have even required he keep whatever he's got secret, lest it jeopardize the case.
