In the US they jack up the maximum one can do for any small time crime(misdemeanor) and then they cut you a deal in your plea to be "nice". The government jacks up sentences so no one will take their case to jury trial with the risk of losing and getting hit with the maximum. And counties/municipalities/cities vary extremely in their sentencing. Contrary to popular belief the harshest sentencing is in rural low population counties. for small time it's typically better to be in urban hellholes because of jail overcrowding. A large number in men in jail(not prison) are there for not paying child support.

No, it's a loophole created by the US Constitution and court district boundaries.
The Constitution guarantees a trial by jury made up of one's peers from the state and district where the crime took place. The Federal Court District of Wyoming covers the entire state of Wyoming plus all of Yellowstone National Park. This means that a jury of your peers must be made up of citizens who both live in Idaho and the Federal Court District of Wyoming. No such people exist because no one lives in the fifty square miles of Yellowstone in Idaho.
You might be able to get away with a crime in Yellowstone, Montana too because only forty people live in the Federal Court District of Wyoming and the State of Montana. A jury only needs twelve members but it usually takes a population several times that to find enough qualified to serve. But why risk it in Montana when you can just go to the part of Yellowstone in Idaho and kill or do anything else there with no risk of being punished.

Yeah, it doesn't sound real but until 2004 no one realized the loophole existed. Congress has simply been too lazy to correct it by changing the court boundaries. The area is pretty remote which is why the loophole hasn't been exploited. If you're going to go somewhere that remote, you'd probably get away with it anyway.
Know what's funny? I went without health insurance for 10 months after leaving a job and working as an independent agent. When I did my taxes, it was on there that I was liable for the tax. You know how I avoided it? I selected a box on the tax returns that said health insurance was too expensive and the penalty was waived. It's paper thin and not enforceable.

The idea that Germans, Swedes, and other "enlightened" European countries can stomach a state judge or local politician just deciding whether you're guilty or innocent based on their interpretation of the law is unbelievable to me. Every one of those fuckers have to tow a party line and get training from a centralized government school meaning state thinking is pushed to the constituents instead of the other way around.

The Supreme Court has long acted in a role not assigned to it by the Constitution: that of the brakes on social change. You can find plenty of court opinions on issues that were too controversial in the day for them to rule against the social convention, only to rule for change a few decades or even a century later. Roberts likely felt it was time for the country to have universal healthcare so he came up with a justification for it by calling it a tax.
This is why conservatives have such a hard on for justices who are strict originalists. They don't want the court taking on a role that really belongs to Congress.

You pay tax for healthcare one way or another. The only true way would be to allow clinics to refuse people who can't pay. Even the emergency room would have the option to refuse. Then you would have absolute freedom of not paying for healthcare. Yes, about 500k people would drop dead. The current way with loopholes and lots of local trickery is just expensive, stupid and mad.

Its not completely true. The problem is that you would need to bring someone to the zone before you perform the crime, or you crime is just gone Federal by abducting someone and moved between states. Also, the locals can always make a true crime federal, by simply calling up the Feds to overtake it. Secondly, they could prosecute you with jurors found elsewhere. It would take at least 10 years before this even reaches the Supreme Court. Someone would rot in jail for so long only to learn that they found a loophole that the conviction sticks? Funny.

We have our few cases, where the system and the Judge really fucks up. Most of the times, the Judge simply recuses himself to an other type of court system or retires. There is a self cleaning system. I know german lawyers and they would have to think really hard to find a misjudgment case like OJ Simpson. We had one some years ago, with lots of people, including a local judge, conspiring to keep one guy in jail. The whole thing went on for month, and the judge retired, but without some hefty benefits. After some years he tried to get them by suing the government, but this went nowhere.
