Being "at war" legally isn't really a thing anymore since declarations of war are a completely out of date concept no one uses anymore. For example, technically Russia and Japan are "at war", but that doesn't mean anything because they're not fighting and have no plans to. What some decades' old declaration of war says about them being at war is irrelevent to today.

That being said, Israel and Syria are hostile, though not in direct combat; Israel reserves the right (which it exercises) to bomb Hezbollah targets in Syria, however.
