Some context here is necessary, in case anyone wants to use this stat when arguing with a liberal and doesn't want to seem uneducated.

The 9th's Circuit's reversal rate is 3rd highest. The 6th (87%) and 11th (85%) are above it. Directly below is the 3rd Circuit (78%).

Indeed, the overall reversal rate for all the federal cases under review by the Supreme Court is 55%.

So, while 80% seems very high on its face, it's not so disproportionately high that it can be said that the 9th Circuit is UNIQUELY ineffective or unqualified or biased. The best that can be said it's that it's reversal rate is well-above average, and third highest overall.

This is faulty logic, as the Supreme Court doesn't review every single decision coming out of the 9th Circuit, and the cases that the Supreme Court does decide to hear can hardly be said to be a representative sample of cases. Indeed, the Supreme Court most often chooses complex cases where there is disagreement among the circuits. These are the close-call cases - the cases where reasonable judicial minds can differ. That's precisely why they make it to the Supreme Court.

Thus, the best that can be said here is: "If the Supreme Court agrees to hear a case coming out of the 9th circuit, there's an 80% chance that it will be reversed." The "IF" is doing all the heavy-lifting in this line of reasoning.
