Mueller Recusal/Removal...NOW

Lawfag here...how is Mueller's obvious conflict of interest in serving as Special Counsel in an investigation where many of the key witnesses/disputes center on persons and institutions with which he has an obvious and substantial personal, professional, and political connection not grounds for immediate recusal/removal? Mueller is a former FBI Director, now investigating a President where key witnesses include Comey, his successor and longtime friend, and now allegedly numerous other FBI high-level personnel. This is in clear violation of the special counsel statute (28 CFR 600.7), and federal law governing DOJ conduct in investigations (28 CFR 54.2). How is this patent conflict of interest being willfully ignored by "bipartisan beacon of integrity" Robert Mueller, as well as those within the AG's office/DOJ?

Shut the fuck up faggot drumpfy is going to be impeached. Republicans themselves can't wait to draw blood they don't care about the outcome.

What if it's not Trump that he's after. What if it's the corruption on the Left that he's investigating? If that's the case, he's the perfect candidate to expose them. The Left's favorite defense, a politically motivated attack, can't be used when charges are brought.

If Trump fires Mueller Congress will appoint another one and republicans will call for his impeachment on obstruction because they are cucks who don't know how to win

>Lawfag here

Stopped believing there. If you were really any attorney you'd be out there chasing ambulances.

I would like to believe this, but constant additions of Dem-leaning attorneys make it even less likely.

when did CIA niggers get so brazen?

Right. The left has spent months now propping Mueller up as a righteous seeker of justice, above reproach. If he indicts Democrats now, they're going to backpedal so hard they'll leave skidmarks.

> !!jGOyfgJ+rKS
>GOy
what did they mean by this

>special counsel statute (28 CFR 600.7)

Outed yourself larper.

Exactly. Mueller is Trump staff. All this chaos is A) so the dems/Media don't see it coming, and B) so they can't turn on Mueller without looking completely hypocritical a la Comey

he is a deep state clinton operative ! REMOVE THIS ENEMY OF THE AMERICAN PEOPLE !!

#ENEMIESDOMESTIC

...

Nice alternate reality you're living in, mate.

...

A statute in muh regulations

I'm a law student. I talked to Mueller at law school and he is badass af. If he isn't actually a stand-up guy, he is very good at selling it. Of course, that's very possible.

28 CFR 600.7 does not define conflict of interest, and a quick skim of Chapter 1 isn't turning up a definitions section. It is likely that "conflict of interest" would not be interpreted to cover Robert Mueller's relationships because most attorneys qualified to act as special counsel are going to have extensive contacts in the DOJ and FBI.

28 CFR 54.2 doesn't appear to be related. Typo?

NONE of these people give a shit about corruption.

If they did then they'd be going after Hillary and Obama for their massive corruption.

It's as the CNN producer said: it's a witch hunt because they don't like Trump.

The people hired under Mueller don't seem to be the types that are investigative/constitutional lawyers. They are lawyers that possibly could have participated in the crimes and international crimes of the Clinton Foundation. The reality is, if President Trump was in any hot water or had done anything wrong, then it would have been released BEFORE the election.

Prove it nigger

Literally 2 min on Westlaw:

(a) Except as permitted by subsection (b) hereof, whoever, being an officer or employee of the executive branch of the United States Government, or of any independent agency of the United States, a Federal Reserve bank director, officer, or employee, or an officer or employee of the District of Columbia, including a special Government employee, participates personally and substantially as a Government officer or employee, through decision, approval, disapproval, recommendation, the rendering of advice, investigation, or otherwise, in a judicial or other proceeding, application, request for a ruling or other determination, contract, claim, controversy, charge, accusation, arrest, or other particular matter in which, to his knowledge, he, his spouse, minor child, general partner, organization in which he is serving as officer, director, trustee, general partner or employee, or any person or organization with whom he is negotiating or has any arrangement concerning prospective employment, has a financial interest--

§ 1:3.Defining conflicts of interest, Conflicts of Interest in Business & Professions § 1:3 (2016)

Pretty easy to see that this doesn't apply to Mueller.

here

Wrong cite, here is the right one:

18 U.S.C.A. § 208 (West)

I don't think donating a total of $54K from the whole team combined to Democrats over 10 years is a major conflict of interest.

conservativeexplorer.wordpress.com/2017/07/19/band-of-brothers-or-harbingers-of-doom-muellers-team-enigma/

You are right. This matter should be investigated by someone completely impartial. I suggest Vladimir Putin. No US ties there.

Typo...should be 28 CFR 45.2

Literally inapposite...financial interest vs.pure conflict. See 28 CFR 45.2.

lol no

18 U.S.C.A. § 208, Conflicts of Interest in Business & Professions § 21:3 (2016)

mueller go home
bumpsies

Also lol:

(c) For the purposes of this section:
(1) Political relationship means a close identification with an elected official, a candidate (whether or not successful) for elective, public office, a political party, or a campaign organization, arising from service as a principal adviser thereto or a principal official thereof; and
(2) Personal relationship means a close and substantial connection of the type normally viewed as likely to induce partiality. An employee is presumed to have a personal relationship with his father, mother, brother, sister, child and spouse. Whether relationships (including friendships) of an employee to other persons or organizations are “personal” must be judged on an individual basis with due regard given to the subjective opinion of the employee.

28 C.F.R. § 45.2

Neither applies. If (1) was to apply then it would apply for his association with the Republican party. Bush appointed him to be FBI director. Obviously, appointments don't create a political relationship because that would preclude all appointees from participating in criminal investigations. It's also telling that you have abandoned your conflict of interest argument. If you were arguing this on appeal you would be restricted from advancing this "novel argument."

Furthermore, the "supervisor" has discretion on whether to remove Mueller. The regulation doesn't force his hand. See:

(b) An employee assigned to or otherwise participating in a criminal investigation or prosecution who believes that his participation may be prohibited by paragraph (a) of this section shall report the matter and all attendant facts and circumstances to his supervisor at the level of section chief or the equivalent or higher. If the supervisor determines that a personal or political relationship exists between the employee and a person or organization described in paragraph (a) of this section, he shall relieve the employee from participation unless he determines further, in writing, after full consideration of all the facts and circumstances, that:
(1) The relationship will not have the effect of rendering the employee's service less than fully impartial and professional; and
(2) The employee's participation would not create an appearance of a conflict of interest likely to affect the public perception of the integrity of the investigation or prosecution.

28 C.F.R. § 45.2

What's hilarious is that this language comes directly from the regulation you cited to me. This means that you are either (a) dumb and couldn't read the whole thing, or (b) purposefully being misleading.

Currently accepting apologies.

many people predicted, months ago, that the reason for muller's selection was to declaw any potential legal action due to this concept of 'conflict of interest'.

Relax, and read:

OP how do you like law school?

Bump

A conflict of interest is a conflict of interest. And the maximum you can give a year is $2700...so they could have been giving the maximum to a particular candidate..
